These Terms & Conditions (“Terms”) govern your access to and use of the Bear Spray Trainingonline training platform (the “Platform”), operated by Backcountry Wildlife Monitoring Ltd. (“BCWM,” “we,” “us”). By creating an account, purchasing a course, or otherwise using the Platform, you agree to these Terms.
1. The training and certification
The Platform provides online wildlife-awareness and bear-spray training courses. Completing a course and passing its final assessment issues a certificate of completion. A certificate attests that you completed the training; it is not a licence, permit, or government accreditation, and it does not guarantee your safety in any wildlife encounter.
2. Certificate validity
- Certificates are valid for the period stated on the certificate (typically 24 months from the date of issue).
- It is your responsibility to retake training before your certificate expires if your employer, project, or jurisdiction requires current certification.
- We may update course content and assessment standards over time; recertification is completed under the standards in effect at the time of retake.
3. Purchases, pricing, and taxes
- Course prices are listed in Canadian dollars (CAD) and are exclusive of tax. Applicable GST is added at checkout.
- Payments are processed by our third-party payment processor (Stripe). We do not store your full payment-card details.
- Corporate accounts may be invoiced monthly under agreed payment terms in place of paying at checkout.
4. Examinations and retakes
- Course completion requires achieving the stated passing score on the final assessment.
- Retake allowances are described on each course. Where unlimited retakes are offered, you may re-attempt the assessment at no additional charge until you pass.
- Sharing assessment questions or answers, or completing training on another person’s behalf, is prohibited and may void any certificate issued.
5. Refunds
- Course content is digital and access is granted immediately on purchase. By starting a course you acknowledge that delivery has begun and you waive any statutory cooling-off or cancellation right to the extent permitted by applicable consumer-protection law.
- Because content is delivered digitally and immediately, purchases are generally non-refundable once you have begun the course.
- If you have not started a course, contact us to request a refund. Refunds, where granted, are issued to the original payment method.
- Corporate billing disputes are handled under the applicable corporate account terms.
6. Intellectual property and licence
- All course materials — including slides, videos, images, assessments, and certificates — are owned by BCWM or its licensors and are protected by copyright and other laws.
- On purchase, we grant you a personal, non-transferable, non-exclusive licence to access the course for your own training. Corporate-purchased seats are licensed to the individual learner assigned to each seat.
- You may not copy, redistribute, resell, publicly post, record, or create derivative works from the course materials, and you may not use automated means to scrape or extract them.
7. Bear spray — important safety and legal notice
Bear spray is a regulated pest-control product in Canada. The following applies to the bear-spray training and to any bear-spray product you may be issued or use:
- Bear spray sold and used in Canada must be registered under the Pest Control Products Act (Canada) and bear a Pest Control Products (PCP) registration number. Use only registered product.
- Use bear spray strictly in accordance with the manufacturer’s label directions and Health Canada requirements. The label is the law.
- Observe all federal, provincial, and carrier rules for the transport and storage of bear spray, including Transport Canada dangerous-goods rules and restrictions on air travel and on transport across borders.
- Training does not authorize misuse. Bear spray is for defence against wildlife only; using it against people may constitute a criminal offence under the Criminal Code of Canada.
- No deterrent is guaranteed effective. Training reduces but does not eliminate the risks of working or recreating in wildlife habitat.
8. Your account
- You must provide accurate information and keep your account credentials secure.
- Certificates are issued in the name on your profile; ensure your legal name and details are correct before completing a course.
- You are responsible for activity under your account.
9. Suspension and termination
- We may suspend or terminate your access if you breach these Terms, misuse the Platform, or share or falsify training or assessments.
- Certificates already validly earned remain valid unless obtained through prohibited conduct (for example, sharing answers or completing training on another person’s behalf), in which case they may be voided.
- You may stop using the Platform at any time; sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, and governing law) continue to apply.
10. Disclaimer and limitation of liability
The Platform and the training are provided on an “as is” basis. To the fullest extent permitted by law, BCWM disclaims all warranties and is not liable for any injury, loss, or damage arising from wildlife encounters, the use or misuse of bear spray, or reliance on the training. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
12. Changes to these Terms
We may update these Terms from time to time. The current version and its “Last updated” date are always posted on this page. Material changes will be reflected by an updated date, and your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
